Terms of Use
These terms apply when you use foodontrains.in (the "website") of foodontrains ("we", "us"). By using the website or placing an order you agree to these terms, our Privacy Policy, our Refund and Cancellation Policy and our Delivery Policy. If you do not agree, please do not use the website.
1. What we do
foodontrains is an online platform that lets train passengers order food from independent restaurants at stations on their route. The restaurant prepares the food and delivers it to your coach and seat. We take the order, pass it to the restaurant, send you updates and, for online payments, collect the payment. We do not cook, pack or deliver food ourselves, and we are not Indian Railways or IRCTC.
2. Who can use the website
You must be at least 18 years old and able to enter into a binding contract under Indian law to place an order. If you order for someone else, such as a fellow passenger, you are responsible for that order.
3. Your journey details
- You must give a correct PNR or train number and date, coach, seat, name and mobile number. We use train information from third-party sources and cannot guarantee it is complete or up to date.
- If your coach, seat or journey changes after you order, tell us or the restaurant straight away. We are not responsible for an order that cannot be delivered because the details given were wrong.
- Keep your phone reachable around the time the train reaches the station, so the delivery person can find you.
4. Orders
- An order is a request to buy food from the restaurant shown. It is accepted when you receive an order code. The contract for the food is between you and the restaurant; we act as the platform that arranges it.
- Each restaurant stops taking orders at its "order by" time before the train reaches the station. Some dishes are only served at certain times of day.
- A restaurant or we may cancel an order, for example if a dish is unavailable, the train is running too late or early to deliver, the train is diverted or cancelled, or the order looks fraudulent. You will be refunded as set out in the Refund and Cancellation Policy.
- We may refuse orders from, or block, anyone who places fake orders, refuses cash orders without reason, or misuses the website.
5. Prices and payment
- Prices on the website are set for foodontrains and may differ from the restaurant's own prices. Taxes and any charges are shown before you place the order, and the amount at checkout is what you pay.
- You can pay online (UPI, cards, netbanking and other methods offered by our payment partner) when available, or in cash to the delivery person at your seat. Online payments are processed by a licensed payment gateway; we do not store your card or bank details.
- For cash orders, please keep the exact amount ready where you can.
- If a price is shown wrongly because of an error, we may cancel the order and refund any amount paid.
6. Food, quality and allergies
- The restaurant is responsible for preparing, packing and delivering the food, its quality and safety, and holding a valid FSSAI licence.
- Dish photos are for illustration; the food you receive may look different. Veg and non-veg marks and descriptions come from the restaurant.
- If you have an allergy or dietary need, check with the restaurant before you order. We cannot guarantee that any dish is free from allergens.
- Report a problem with your food as described in the Refund and Cancellation Policy.
7. Delays and things outside our control
Trains can run late, early, change platform, skip a stop or be cancelled, and we cannot control this. Delivery times are estimates. We are not liable for failure or delay caused by events beyond our reasonable control, including train operations, railway or government orders, weather, strikes, network or power failures, and natural disasters.
8. Your conduct
You agree not to:
- give false information or place orders you do not intend to accept;
- use the website for anything unlawful, or to harass or abuse restaurant or delivery staff;
- copy, scrape or interfere with the website, or try to access parts of it you are not allowed to;
- upload or send anything harmful, such as viruses.
9. Intellectual property
The foodontrains name, logo, design and content belong to us or our licensors. Restaurant names, menus and images belong to the restaurants or their owners. You may use the website for your personal, non-commercial use only.
10. Limitation of liability
The website is provided "as is". To the extent the law allows, we are not liable for any indirect or consequential loss, and our total liability for any order is limited to the amount you paid for that order. Nothing in these terms limits any right you have under the Consumer Protection Act, 2019 that cannot be excluded.
11. Indemnity
You agree to compensate us for any loss or claim caused by your breach of these terms or your misuse of the website.
12. Changes
We may update these terms from time to time. The version on this page, with its date, applies to orders placed after that date. Continuing to use the website means you accept the updated terms.
13. Law and disputes
These terms are governed by the laws of India. Any dispute will first be raised with our Grievance Officer below. If it is not resolved, the courts at New Delhi will have jurisdiction, without affecting your right to approach a consumer commission.
